Petris v. Sportsmans Warehouse, Inc., et al.

Case No. 25-CV-06320
Court of Common Pleas of Washington County, Pennsylvania

Welcome to the Settlement Website for Sportsman’s UFA Settlement

A settlement has been reached in a class action lawsuit against Sportsman’s Warehouse, Inc. and Sportsman’s Warehouse Holdings, Inc. (“Defendants”), claiming that Defendants disclosed information pertaining to firearm purchases on their website to third parties without consent in violation of the Pennsylvania Wiretapping and Electronic Surveillance Control Act, 18 Pa. Cons. Stat. § 5701, et seq. (“WESCA”) and the Pennsylvania Uniform Firearms Act, 18 Pa. Cons. Stat. § 6111(i) (“UFA”). The Court did not resolve the claims and defenses raised in this action. Nor has the Court determined that Defendants did anything wrong or that this matter should be certified as a class action except if the Settlement Agreement is fully approved by the Court. Defendants deny all allegations, deny any wrongdoing or liability, and maintain that they complied with the law at all times. However, the Parties have agreed to the settlement to avoid the uncertainties and expenses associated with continuing the case.

You are included if from January 1, 2020, through March 13, 2024, you ordered and reserved a firearm online from Defendants’ website for purchase to be completed in-store while residing in Pennsylvania. If you do intend to submit a Claim Form as described below, you will need to attest under penalty of perjury that from January 1, 2020, to and through March 13, 2024, you ordered and reserved a firearm online from Defendants’ website for purchase to be completed in-store while residing in Pennsylvania.

Persons included in the Settlement will be eligible to submit a Claim Form to receive a payment of up to $107.00.
